Notification

 

 

In exercise of the powers conferred by sub-sections (1) and (2) of Section (3) of the Karnataka Government Parks (Preservation) Act, 1975, (Karnataka Act 23 of 1975), the Government of Karnataka in supersession of Government Notification No. AAH 381 AHM 83 dated 27th September 1983 hereby specifies for the purpose of the said section all lands and buildings within the limits of the park known as Cubbon Park (renamed as Sri. Chamarajendra Park) the situation and limits of which shall be as specified in the schedule below.

 

 

SCHEDULE

 

 

Boundaries of Sri Chamarajendra Park (formerly Cubbon Park) Bangalore

 

NORTH:

Right side area of Legislators’ Home Circle Road touching now Raj Bhavan Gate.  Thereafter along the Raj Bhavan compound wall upto Thimmaiah Circle.  Then upto General Post Office Compound and Central Telegraph Office compound ending at Edward Statue Circle.

NORTH EAST:

Upto and along the Queen’s Road from Edward Statue Circle to Queen’s Statue  Circle. 

SOUTH EAST:

Along the Kasturba Road from Queen’s Statue Circle to Siddhalingaiah Circle upto and inclusive of C. P. C. office aquarium and Cubbon Park Police Station upto and inclusive of V. I. T. M., Government Museum, and Venkatappa Art Gallery, then along the Kasturba Road from Siddalingaiah Circle to Hudson Circle.

SOUTH WEST:

Upto and along the Nrupathunga Road from Hudson Circle to K. R. Circle

NORTH WEST:

Upto and along Dr. Ambedkar Veedhi from K. R. Circle to Gopalagowda Circle.

WEST:

Along the Residency Park Road from Gopalagowda Circle leading to triangle Circle opposite to Devaraj Urs Statue.  Thereafter along the right side of Legislators’ Home Road ending at Legislators’ Home Circle.

THE KARNATAKA GOVERNMENT PARKS (PRESERVATION) ACT, 1975

 

(Receive the assent of the Governor on the 9th day of May 1975)

 

An act to make provision to ensure the preservation of certain Government Parks in the state of Karnataka.

 

Whereas it is expedient in public interest to preserve certain parks vested in the State Government in the State of Karnataka.

 

Be it enacted in the Karnataka State Legislature in the Twenty Sixth year of the Republic of India as follows:

 

1.       Short title and commencement –

(1) This act may be called the Karnataka Government Parks (Preservation) Act, 1975.

 

(2) It shall come into force at once.

 

2.       Definition: In this Act unless the context otherwise requires ‘Park’ includes a garden.

 

3.       Application of the Act:

(1) This Act shall apply to all lands and buildings within the limits of such parks belonging to the State Government as the State Government may from time to time by notification in the official Gazette, specify

 

(2) Notification referred to in Sub-section (1) shall specify as nearly as possible, the situation and limits of such parks.

 

4.       Preservation of Parks:

(1) It shall be the duty of the State Government to preserve and maintain as Horticultural Garden the parks to which this Act is applicable and take such action may be necessary to improve the utility of such parks as such gardens.

 

(2) No land or building within the parks to which this is applicable shall be alienated by way of sale, lease, gift, exchange, mortgage or otherwise or no licence for the use of the such and or building shall be granted and any alienation of licence granted in contravention of this section shall be null and void.

 

Provided that the restriction under this sub-section on lease shall not apply in the case of buildings existing on date of coming into force of this act.

Sub:  Grant of land in Cubbon Park and Lalbagh – Instructions – reg.,

 

ORDER NO.  AAH 264 AHM 78 BANGALORE DATED 14TH NOVEMBER 1979

 

PREAMBLE:-

 

Frequent requests are being received from various organisations and Associations for allocation of space in the Cubbon Park and Lalbagh areas for purposes of construction of buildings.  The Bal Bhavan authorities have also been requesting for allocation of additional space for putting up temporary structure etc.  According to the provision of Karnataka Government Park (Preservation) Act, 1975, no additional land can be granted for construction purposes, in these parks.  The entire question is, however examined with regard to the preservation of unique atmosphere in these areas and the Government have decided not to allow any more construction by any of the organisation or individuals in both Cubbon Park and Lalbagh.

Order:

Accordingly, it is directed that neither any land should be granted to nor any further constructions be permitted whether temporary or permanent by any organisation or individuals in the Cubbon Park and Lalbagh areas except the constructions taken up by the Horticulture Department in furtherance of the objectives of the department.
